All business with Pearson Parties Direct Ltd (trading as Parties Direct), including transactions on www.parties-direct.com, are subject to the following Terms and Conditions of sale. Parties Direct reserves the right to amend its Terms and Conditions from time to time and the customer is bound by any such modifications or revisions.
Health & Safety
The use of any party product should be supervised at all times by an adult. All products sold by Parties Direct comply with the European Toy Safety Regulations and/or bear the CE Kitemark. Particular attention must be paid to the use of helium gas cylinders, for which specific safety information is available on this site. The customer shall be responsible for ensuring that all statutory, government or local authority regulations are complied with in relation to the use of any products purchased from Parties Direct.
Contract
By submitting any order for the purchase of goods from Parties Direct, you agree to be bound by the Terms & Conditions of sale. Each purchase order becomes a binding contract between Parties Direct and you, the customer. These Terms & Conditions shall prevail over and supersede all terms and conditions stipulated by you, and you acknowledge that in agreeing to them you have not relied on any representation, warranty or other assurance except those set out herein. The contract comes into effect upon receipt of payment from Parties Direct.
Pricing
Prices of products are inclusive of VAT (at the standard UK rate). An additional delivery charge applies. Parties Direct reserves the right to change prices without notice. Prices quoted at the time of transaction will remain fixed. All orders are subject to availability.
Warranty
Parties Direct offers no warranty in respect its products, which are manufactured by independent third parties. However, any discrepancies between the customer’s order and the items delivered, or any damaged or defective goods or goods lost in transit, will be rectified via a full refund or replacement.
Payment
Parties Direct will fulfill orders only after the correct price (at time of order) has been paid, unless prior arrangements have been made. All orders must be paid for in United Kingdom Pounds (£) Sterling cheques drawn on a bank account located within the United Kingdom.
Delivery
Parties Direct will endeavour to adhere to the timescales that correspond to our delivery options. Failure to comply entitles the customer to a full refund, but no further compensation. Despatch of goods constitutes fulfillment of contract.
Parties Direct shall not be liable for delay or failure to deliver products promptly if such failure arises due to any reason of force majeure, including but not limited to reasons of delays occasioned by strikes, riots, lockouts or other labour trouble, war, fire, accident, mechanical failure, non-availability to Parties Direct of manufactured stock, packaging, or materials; delay or failure of delivery of the products to Parties Direct by manufacturers, suppliers or other persons; government action, legislation or regulation of any kind; Act of God, or any circumstances whatsoever outside our reasonable control.
Cancellation
Customers may cancel an order up to 5 working days after delivery of the order. Cancelled orders must be returned at the customer’s expense (except in cases of faulty, damaged or wrongly supplied goods). A full refund will be issued within 3 working days of receipt of goods as long as they are received by Parties Direct in good condition.
Product Specifications
Parties Direct reserves the right to modify or update its product portfolio or change suppliers at any time without notice. Such changes shall not affect the validity of any contract with the customer, provided that any variations or modifications do not adversely affect the aesthetics, quality or performance of the products. Where there has been a material change to any product ordered by the customer, Parties Direct will supply a product that is almost identical to that ordered.
Disclaimer
The site and the materials on the site are provided "as is" and without representations or warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, Parties Direct, its officers, directors, employees, affiliates, suppliers, advertisers, and agents disclaim all warranties, express, implied or statutory, including, but not limited to, implied warranties of title, non-infringement, suitability, and fitness for a particular purpose, and all warranties relating to the adequacy, accuracy or completeness of any information on the site.
Customer Obligations
For on-line payment, Parties Direct uses Worldpay, a recognised on-line credit payment agency who have secure server software encryption to keep your transaction private and protected. When you purchase goods through this site, you will be asked to enter details of a credit, debit, or charge card. By providing any such details you confirm that (a) you are fully entitled to use that card both at the time when you enter its details and when you seek to use it, and (b) there are sufficient available funds to cover all costs, charges and deductions incurred through the use of such card for the purchase of such goods.
If any of the information you enter becomes incorrect or is superseded, then you agree to inform Parties Direct immediately.
Limitation of Liability
